edvocat limited provides SEND advocacy support, resources, and related services to families in England & Wales.

2. Nature of Services

We provide information, advocacy support, and resources relating to Special Educational Needs & Disabilities (SEND). Our support is grounded in the Children & Families Act 2014, SEND Code of Practice 2015, Education Act 1996 (including sections 19 and 42), the Equality Act 2010, and relevant SEND Tribunal case law. We do not provide legal representation or medical advice.

Outcomes (e.g., needs assessments, EHCP content, placements, or tribunal decisions) depend on third parties (schools, Local Authorities, tribunals). We cannot guarantee any specific outcome.

3. Memberships & Payments

  • Membership is billed at £9/month (or £90/year if selected) via our payment processor.
  • Membership provides access to member resources and discounted service rates. Add-on services are charged separately.
  • You may cancel any time. Cancellations take effect at the end of the paid period. No refunds for partial periods.
  • We may change pricing with notice; changes will not affect current paid periods.

4. Hourly & Add-On Services

  • Standard rate: £35/hour (members: £30/hour), billed in 30-minute increments.
  • Typical timescales published on our site are estimates only and not guarantees.
  • Work begins once scope, rate, and timelines are agreed in writing (email is sufficient).
  • If circumstances change (e.g., new documents, deadlines), we will agree revised scope and cost before proceeding.

5. Digital Products & Licence

  • Templates, guides, downloads, and recordings are provided under a single-user licence for your personal use.
  • Re-use, redistribution, resale, or sharing (including within social groups or forums) is prohibited without written permission.
  • Due to their nature, digital products are non-refundable once accessed/downloaded.

6. Meetings, Representation & Boundaries

  • Where agreed, we can attend meetings (online or in person). Travel time/expenses may apply.
  • We act as advocates and advisors; we are not solicitors and do not conduct reserved legal activities.
  • We will not contact your child’s school or Local Authority without your written instruction.

7. Confidentiality & Data Protection (GDPR)

We are committed to confidentiality and data protection under the UK GDPR and Data Protection Act 2018.

  • Lawful basis: We process personal data to perform a contract with you and, where applicable, with your explicit consent.
  • Data we process: Contact details, case information, documents you supply, communications, billing data.
  • Use of data: To provide services, manage your membership, and improve our resources.
  • Third-party processors: We may use trusted providers to operate our service (e.g., Squarespace for hosting, Stripe for payments, email and cloud storage providers). We ensure suitable data processing terms are in place.
  • Confidentiality: We do not share your data with third parties unless you ask us to, it’s necessary to deliver the service, or we are legally required to.
  • Security & retention: We retain data only as long as necessary for the purpose collected and to meet legal obligations. We take reasonable technical and organisational measures to protect data.

8. Fair Use & Reasonable Behaviour

  • We’re a small team. To keep services fair, we may set reasonable limits on response frequency/length within membership channels.
  • We reserve the right to decline or terminate services where behaviour is abusive, discriminatory, or unreasonable.

9. Disclaimers

  • We take care to keep resources accurate and up to date, but guidance is general. Case-specific advice depends on your facts and documents.
  • External links and third-party resources are provided for convenience; we are not responsible for their content.

10. Limitation of Liability

  • We are not liable for decisions taken by schools, Local Authorities, the NHS, or tribunals, nor for indirect or consequential loss.
  • Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
  • Subject to the above, our total liability in connection with any service is limited to the amount you paid for that service.

11. Cancellations & Refunds

  • Membership: Cancel any time; access continues to the end of the paid period. No partial-period refunds.
  • Hourly/add-on services: If you cancel after work has begun, fees for time spent are chargeable.
  • Digital products: Non-refundable once accessed/downloaded.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on our website or by email to active members. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over disputes.
